Terms of Service

1. About FreelancePilots

FreelancePilots.uk ("FreelancePilots", "we", "us", "our") is an online directory and communication platform operated as a sole trader business based in England, United Kingdom.

FreelancePilots provides a marketplace that connects licensed pilots ("Pilots") with aircraft owners, charter operators, and other aviation businesses ("Operators") who require freelance or contract flight crew services. We are a technology platform only.

FreelancePilots is not an aviation operator, an Air Operator Certificate (AOC) holder, a flight crew agency, a recruitment business, an employer, or a party to any agreement made between Pilots and Operators through this platform.

2. Eligibility

By creating an account you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into binding contracts under English law
  • You will use the platform only for lawful purposes
  • All information you provide is accurate, current, and complete
  • You will keep your account information up to date

We reserve the right to suspend or terminate any account at our discretion, including where we have reason to believe eligibility requirements are not met.

3. Pilot accounts

By creating a Pilot account and listing a profile on FreelancePilots, you agree that:

  • All information on your profile — including type ratings, total hours, PIC hours, licence type, and authority — is accurate, current, and not misleading
  • You hold a valid pilot's licence and current Class 1 or Class 2 medical certificate appropriate for any work you agree to undertake
  • You will update your profile promptly if your qualifications, ratings, or currency change
  • You are solely responsible for ensuring you are legally entitled to conduct any flight you agree to perform
  • You understand that you are operating as a self-employed individual and are responsible for your own tax obligations, National Insurance contributions, and compliance with HMRC rules
  • FreelancePilots does not provide professional indemnity, liability, or any other insurance cover for flights conducted through connections made on this platform
  • You will not submit false, misleading, or unverifiable information to your profile

4. Operator accounts

By creating an Operator account and using FreelancePilots to find flight crew, you agree that:

  • You are responsible for ensuring any pilot you engage is appropriately qualified, licenced, and current for the specific aircraft and operation
  • You will independently verify all pilot credentials before any flight takes place — see Section 5
  • You are responsible for ensuring your own insurance policy covers hired or freelance pilots
  • You will comply with all applicable UK Civil Aviation Authority (CAA), European Union Aviation Safety Agency (EASA), and any other relevant regulatory requirements governing your operation
  • If you hold an Air Operator Certificate (AOC), you are responsible for ensuring any freelance pilot meets your operations manual crew approval requirements before conducting commercial flights
  • You accept that FreelancePilots is not a party to any agreement or arrangement you make with a Pilot

5. Credential verification — important

⚠️ FreelancePilots does not verify, check, authenticate, or confirm any pilot credentials, qualifications, type ratings, medical certificates, logbook hours, or any other information displayed on pilot profiles. All profile information is self-reported by pilots.

It is the sole and absolute responsibility of the Operator to independently verify all of the following before engaging any pilot found through this platform:

  • The pilot's licence is valid, current, and issued by the stated authority (UK CAA, EASA, FAA, or other)
  • The pilot holds the correct type rating for the specific aircraft variant to be flown
  • The pilot's medical certificate is valid and has not expired
  • The pilot is current and meets the recency requirements for the intended operation
  • The pilot's qualifications are appropriate for the category of flight (private, commercial, CAT, etc.)
  • The pilot meets any minimum hour requirements specified by your insurer

UK CAA licences can be verified at the CAA's public register. EASA licences can be verified through the relevant national aviation authority. FreelancePilots accepts no responsibility for the accuracy of information on pilot profiles.

By using the platform to engage a pilot, you confirm you have carried out all necessary verification and that FreelancePilots bears no liability whatsoever for any failure to do so.

6. Financial disclaimer

FreelancePilots is not involved in any financial transaction between Pilots and Operators. We do not:

  • Process, hold, or transfer any payments between users
  • Set, recommend, or guarantee any pilot day rates or fees
  • Take commission on any flights arranged through the platform
  • Guarantee payment to Pilots for work carried out
  • Mediate or resolve financial disputes between users

Any rate agreed between a Pilot and an Operator is a private arrangement entirely between those two parties. FreelancePilots accepts no liability for non-payment, underpayment, or any other financial dispute.

Operators using the platform pay a subscription fee to FreelancePilots for access to the platform only. This fee is separate from and unrelated to any payments due to Pilots.

7. No employment relationship

FreelancePilots does not employ any Pilot listed on the platform. No employment, worker, or agency relationship exists between FreelancePilots and any Pilot or Operator user.

Pilots using this platform are independent contractors. They are responsible for their own:

  • Income tax and National Insurance via Self Assessment
  • Professional and personal insurance
  • Compliance with UK working time regulations as self-employed individuals
  • Any contractual obligations to existing employers, including exclusivity clauses

FreelancePilots does not constitute an employment agency within the meaning of the Employment Agencies Act 1973 and does not provide recruitment services.

8. Limitation of liability

To the maximum extent permitted by English law, FreelancePilots accepts no liability for:

  • Any aviation incident, accident, near miss, or regulatory breach arising from connections made through the platform
  • Loss or damage arising from reliance on unverified pilot profile information
  • Any financial loss arising from disputes between Pilots and Operators
  • Any consequential, indirect, or special loss of any kind
  • Loss of business, revenue, profit, or data
  • Service interruptions or platform downtime

Where liability cannot be excluded by law, our total aggregate liability is limited to the total subscription fees paid by you to FreelancePilots in the 12-month period preceding the event giving rise to the claim, or £100, whichever is greater.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Prohibited conduct

Users of FreelancePilots must not:

  • Submit false, misleading, or fabricated credentials, qualifications, or personal information
  • Impersonate any person or entity
  • Use the platform to arrange flights that would be unlawful under UK or EU aviation law
  • Harass, threaten, or abuse other users through the messaging system
  • Use the platform for any purpose other than connecting Pilots and Operators for legitimate freelance aviation work
  • Attempt to circumvent, disable, or interfere with platform security features
  • Scrape, copy, or reproduce profile data for commercial purposes
  • Use the platform to solicit users to competing services

Violations may result in immediate account suspension without refund of any subscription fees.

10. Account termination

You may delete your account at any time by contacting us at legal@freelancepilots.uk. Deletion will result in your profile being removed from the platform and your personal data being deleted in accordance with our Privacy Policy, subject to any legal retention requirements.

We may suspend or terminate any account at our sole discretion, including for breach of these Terms, conduct we deem harmful to the platform or its users, or any behaviour that may bring FreelancePilots into disrepute.

Subscription fees are non-refundable on termination for breach.

11. Changes to these terms

We may update these Terms of Service from time to time. We will notify registered users by email at least 14 days before any material changes take effect. Continued use of the platform after the effective date of changes constitutes acceptance of the revised Terms.

The current version and date of these Terms is always shown at the top of this page.

12. Governing law

These Terms of Service are governed by the laws of England and Wales. Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
